Crash Helmet, Safety Harness Now Must For Kids Below 4 Years On Motorcycles

Road Ministry Mandates Usage Of Safety Harness & Crash Helmet

The Ministry of Road Transport and Highways (MoRTH) has issued new safety standards for two-wheeler riders who are carrying children as pillion passengers, which include the use of a crash helmet for children aged nine months to four years and a safety harness to secure the youngster to the rider. The maximum speed restriction for these two-wheelers would be 40 kilometres per hour. The new regulations will take effect on February 15, 2023. A punishment of Rs. 1,000 and a three-month suspension of the driver’s licence would also be imposed if these new restrictions were introduced.

According to the notice, “The Ministry of Road Transport and Highways, vide notification dated 15th February 2022 has amended Rule 138 of CMVR, 1989 and has prescribed norms related to safety measures for children below four years of age, riding or being carried on a motorcycle This has been notified under Section 129 of the Motor Vehicles Act, which mandates that the Central Government may, by rules, provide for measures for the safety of children below four years of age, riding or being carried on a motorcycle. Further, it specifies the use of a safety harness and crash helmet. It also restricts the speed of such motorcycles to 40 kmph. These rules will come into force after one year from the date of publication of the Central Motor Vehicles (Second Amendment) Rules, 2022.”

When riding a two-wheeler with a youngster as a passenger, riders must limit their speed to 40 kmph. In October of last year, the Ministry of Road Transport and Highways (MoRTH) released a draught regulation seeking to increase the safety quotient by limiting the speed of two-wheelers with children under the age of four years to no more than 40 kmph. Children from nine months to four years who ride pillion on a two-wheeler will be required to wear a crash helmet, according to the ministry.
